Butler wrote the initial version of the Civil Rights Act of 1871 (also known as the Ku Klux Klan Act). After his bill was defeated, Representative Samuel Shellabarger of Ohio drafted another bill, only slightly less sweeping than Butler's, that successfully passed both houses and became law upon Grant's signature on April 20.[4][8] Along with Republican Senator Charles Sumner, Butler proposed the Civil Rights Act of 1875, a seminal and far-reaching law banning racial discrimination in public accommodations.[9] The Supreme Court of the United States declared the law unconstitutional in the 1883 Civil Rights Cases.[10]
